摘要/Abstract

摘要： 农民土地权益保护是农民权益保护的主要内容，是解决 “三农” 问题的关键所在。农民土地权益保护需要立足法治化路径，农民土地权益保护地方性立法是农民土地权益保护法治化路径的重要部分。农民土地权益保护的地方立法经验，主要体现为贯彻上位法、凸显地域性，过程民主化、内容创新性，适应客观需求、体现探索性。农民土地权益保护地方性立法是一个不断发展完善的过程，未来的地方立法将完善体系化、减少分散化，创新区域立法协同性、降低立法成本，注重法律清理、防止法规冲突，回归人本性、防止唯地化。

Abstract: The protection of farmers’land rights and interests comprises the main content of the protection of farmers’general rights and interests，and it is the key to solving the“three rural issues” . The protection of farmers’land rights and interests must be guaranteed by law and legislation at the local levels is an important means in this respect. The experience of local legislation is characteristic of implementing higher-level law，regional features，democratic process，innovative content，meeting objective needs，and reflecting an exploratory spirit. Local legislation for protecting farmers’land rights and interests is still in the process continuous improvement；it will aim to be more systematic than segmental，innovate regional coordination， reduce legislative cost，weed laws，prevent conflict rules，emphasize human care，and avoid extreme regionalism.
