Diversified management is a cross- product and cross- industry mode of operation an enterprise adopts when it has developed to a certain stage. In recent years,with the development of China’ s economy,tourism industry has obtained rapid development, but the concept of“individual tours”and the advancement of mobile Internet technology have a remarkable impact on the tourism enterprises. They have to find new profit growth points through new management means and methods. This paper,which uses the samples of 205 listed tourism companies in China during the 2007-2014 period,empirically tested the influence of political association and real earnings management on the travel enterprises’diversified management. The study finds that,compared with listed companies with no political association, politically associated companies’have a higher degree of diversification and that the higher the degree of real earnings management,the lower the diversification. Taking into consideration the real earnings management’ s intermediate role,the paper finds that the influence of political association on diversification is restricted,and the influence of real earnings management on diversified management varies in companies with different levels of political association.

Organizational learning and strategic flexibility are important abilities of new ventures to obtain competitive advantages in the complex and ever-changing external environment,and entrepreneurial leadership,which has an important role in enhancing the performance of new ventures,is a key driver for new setups to maintain their competitive advantage and strategic values. This paper studies the multiple mediating effects of organizational learning ability and strategic flexibility between entrepreneurial leadership of CEOs and the performance new ventures based on strategic entrepreneurship and upper echelons theories. The empirical analysis of the sample data of 213 new venturesshows that entrepreneurial leadership of CEOs has a significant positive impact on both organizational learning ability and strategic flexibility of new ventures; the relationship between entrepreneurial leadership and new ventures’ performance is completely mediated by organizational learning ability and strategic flexibility;and the difference between the mediating effects of organizational learning ability and strategic flexibility is not significant. The conclusions of this study contribute to a deeper understanding of the influence mechanism of entrepreneurial leadership on the performance of new ventures.

At the backdrop of economic transformation and institutional changes,trans- regional workforce mobility has become an important social phenomenon in today’s Chinese labor market. The study of the relationship between the join effect of human and social capitals and the income of the mobile population is of significance in improving the existing circumstances of this group of people. Using the data of chips 2008,this paper analyzed the reciprocal effect of human and social capitals on the income of the mobile population.Regression analysis arrives at the conclusion:1. both human and social capitals have noticeable promotional effect on the income of the mobile population;2. human capital is more effective than social capital;3. the joint-effect mechanism of human and social capitals produces a substitution effect on the income.

The theory of crime’ s second offense against the law is taking shape,but it is still necessary to elaborate on how and to what degree the theory’s prepositive laws tally with the criminal law. This theory is actually the result of the extension and decomposition of the the criminal law’ s“second”normative attribute;properly handling the relationship between the criminal law and departmental laws is the key to deepening the tolerant spirit. The value of criminal penalty lies in the protective nature of the criminal law and the adoption of criminal penalty should consider the application of prepositive laws. The theory is recounted in the progressive model of“prepositive laws——criminal law”,always treating the criminal law as the last option after full consideration of prepositive laws. This theory is obviously based on “evidence” rather than “experience”, and thus scientific methodologically. The most important theoretical significance is its emphasis on examining and analyzing the“legal environment”and is important in guiding criminal legislation and justice.

The Organizational Law of the People’ s Court and other relevant laws have given the Supreme People’s Court the power of interpretation on how laws are specifically used in judicial activities. This normative power of legal interpretation is granted by the organ of the highest state power for the purpose of unifying the judicial power,but this authorization does not mean the people’ s courts and judges of all levels are deprived of rights of discretion and interpretation in legal applications. In practice,however,some of the judicial interpretations clearly suggest that the Supreme Court has gone beyond the power endowed by the law,presenting a tendency of“legislation” . Therefore,the Supreme Court’ s normative power of interpretation should accept the supervision of the standing committee of the National People’ s Congress and should not,on the contrary,infringe upon the power of legal interpretation of the standing committee.

Robert Hass is an American Modernist poetand an expert intranslationand literary criticism as well.With the word flow,Hass opens up a path into the sub- consciousnessand consciously inducesa“hypnotic state” through the poetic rhythms. As a poet, Robert Hass uses hypnotic language to create a dream- like feeling. Meanwhile,the sober reality often makes the poet wake up the dream at the end of the poem. This paper analyzes the art of hypnosis of Hass’poetry in three aspects:1. Hass plants word flow into poetry and,with the flow of seasonal words,he breaks the boundaries of time and space to create a dream-like feeling in his poetry;2.“light” in Hass’poetry often softens the reality,purifies the memory,and helps to wake up nightmares;3. the essence of the hypnosis in his poetry is to soften the reality. Hass takes poetry as the container to carry the weight of reality,a weight that life can hardly bear.

Located in mountains in western Yunnan Province,Lancang,a state- level poverty stricken county,has contiguous poor areas. Serious regional poverty has made contiguous development the county’s major poverty relief strategy. The comprehensive poverty relief project in the Lahu nationality area,which started in 2010,has become the county’ s largest model of contiguous development and resource integration.Under unified planning,the area put together all types of poverty relief funds and formed a joint force,making it possible for all specific poverty relief projects to mutually promote beneficially. The main effectiveness is reflected in plural channels of fund integration,contiguous construction of infrastructures,and large- scaled poverty alleviation industries. Due to various factors,however,problems still exist in resource integration such as obstacles in financial integration,imbalanced poverty relief project structures,weak effect in industry- driven revenue increment,and insufficient project supervision. To solve these problems,poverty relief fund integration should be planned at the provincial and municipal levels,poverty alleviation industries should distributed from the trans-regional perspective,poor local people’ s participation in industrial development should be increased, and supervision should be strengthened over local governments in the process of project implementation.

Inrigidly stratified ancient China,equality was only some“reckless”individuals’marginal call;it,however, turned out to an axiom of mankind in the minds of intellectual elites such as Kang Youwei and Tan Sitong since the Opium War. The lofty position of equality was the result of the serious unequal positions between China and Western powers. Kang and Tan admired the advanced cannons and warships,political systems and ideas of Western powers so much that they generously accepted their concepts of democracy,freedom,and equality. They did not accept the concept of equality like John Locke’ s“tabula rasa”,though.Instead,they tried to find basis from the ancient traditional Chinese ideological sources. Due to the absence of individualist tradition and the underdevelopment of capitalist commodity economy in China,Kang and Tan misread equality in its modern sense. Nevertheless,ever since them,equality has attracted more and more attention of the mainstreamelites and become animportant part of China’ s modern spirit.

Emperor Wu of Han(汉武帝)had two images - a tyrant and a hero - in Song Dynasty,which are connected not only with his own complex personalities,but also the revival of Confucianism and military confrontations among several nationalities at the time. Since Song scholars idealize those times of the Three Generations(三代)and monarchs of Yao(尧) and Shun(舜),mainstream ideology regarded Emperor Wu of Han as a tyrant like the First Emperor of Qin. Nevertheless,Song monarchs and Xindang(新党)and Nandu(南渡)officers,from the view of political consideration and for the purpose of overcoming crisis,highlighted his image of a hero in a biased and utilitarian manner. The mainstream ideology which looks upon Emperor of Han,a monarch of significant achievement,as a tyrant,is a manifestation of the traditional Chinese mentality of honoring benevolent governance(王道)and denouncing domineering rules(霸道) . This also historically reveals why China adheres to the idea of peaceful development.

As an effective translation method,zero-translation has been broadly utilized by translators in the translation of various texts and a great number of English words have entered Chinese language via zero translation. In recent years,the academic literature and papers related to zero-translation tend to repeatedly explain and analyze its definitions and classifications while few researchers critically investigate its negative effects on science and technology,politics,economy and culture,and other fields. Therefore,based on the definitions,major views of researchers,and current application of zero translation,this essay tries to critically analyze some related policy issues as well as the negative effects of zero- translation on bovementioned fields. The essay also points out that translators,instead of heavily relying on zero- translation,shall explore the potentials of the Chinese language for the protection of the Chinese national language and culture.
