Abstract: As part of the proposed new sixteen words guiding principle of legal construction，scientific legislation conforms to the current situation of that China’s socialist legal system has been formed，it may grasp the principal contradiction in our legislative field，highly targeted. Scientific legislation refers to that，legislative activities，as purposeful，conscious ones，on the basis of that with full understanding and respect for the objective law of development of things，should accurately respond to the objective legislation demands of reality of social life，to achieve unity of subjective and objective. This new sixteen words guiding principle does not highlight the democratic legislation，not meant to undermine it，nor more negation of democratic legislation. Moreover，to achieve scientific legislation，the role of democratic legislation also should be in the affirmative.
