Abstract: In the past 30 years of reform and opening up，the Leadership Council of NPC Standing has played a positive role in a certain extent，to meet the times needs of smooth transition of Chinese society. But in the context of the rule of law in China，to uphold and improve the people’s congress system，when facing the reality of that the Leadership Council of NPC Standing expanding its right，such as leading NPC Standing obviously，from time to time exceeding its authority to make decision instead of NPC Standing，it is necessary to analyze the causes，to limit the powers of the Leadership Council of NPC Standing，to improve the people’s congress system.
