Abstract：With the increasing mobility of elements between urban and rural areas in China，the power and function dilemma，caused by the closed allocation of rural residential land under the framework of“two rights division”has become increasingly prominent. The closure has blocked the mobility of elements between urban and rural areas，resulting in the imbalance of urban and rural development. A framework for the analysis of “three rights division”of rural residential land based on the mobility of elements between urban and rural areas is constructed. Taking the basic requirements of urban-rural elements mobility as a logical starting point，the framework explains the basic functions，direct functions，and ultimate functions of the“three rights division”system. On ths basis，the realization form of strengthening the ownership of rural residential land， guaranteeing the qualification rights， and revitalizing the utility rights is systematically analyzed from the perspective of integrated urban and rural development.

Abstract：The judging standard of attention capacity in business negligence crime is based on the judging standard of attention capacity in general negligence crime. From the dimension of constructing the judgment standard of attention capacity in negligence crime，main arguments exist between the single judgment standard and the double judgment standard. Among them，the single judgment standard includes the subjective theory，the objective theory，and the eclectic theory；the double judgment standard mainly includes the illegality-responsibility double judgment standard and the norm-fact double judgment standard. Compared with other judgment standards，the norm-fact double judgment standard is more reasonable in terms of hierarchical division standard and the recognition of subjective and objective issues.It conforms not only to the judgment process of negligent crime attention capacity，but also to the provisions of China’s criminal law. Therefore，the judging standard of attention capacity in business negligence crime should be constructed on the basis of the norm-fact double judgment standard and in combination with the characteristics of business negligence crime and the normative protection purpose of the criminal law：at the level of norm，legal regulations should be upheld as the judgment standard；at the level of fact，negative and exclusive judgments should be made based on factors of the perpetrator.

The“Case of Dissuading a Smoker in Elevator”happened in Zhengzhou City，Henan Province has come under intense social concern from the very beginning. The different judgments of the Court of First Instance and the Court of Second Instance were made out of considerations of different effects，which have triggered a renewed discussion on the relationship between legal and social effects. The Court of First Instance applied the principle of fair liability in its judgment and ordered Yang Huan，the person who dissuades the smoker，to compensate the family of the deceased；its main concern is the social effect of the case，with the intention of calming and resolving the dispute；the Court of Second Instance denied the rationality of applying the principle of fair liability by the Court of First Instance from the perspective of legal causality，commuted and rejected all the claims of the appellant. There are three kinds of thoughts over the relationship between legal effect and social effect：the“instrument theory”，the“separation theory”and the “unification theory”. The“unification theory”is the most reasonable，which manifests the legal effect by correctly applying the law to achieve the unification of judicial verdict’s certainty and correctness. Among the two，correctness ensures that the verdict conforms to social justice and realizes the social effect of the verdict，which further guarantees the unification of the verdict’s legal effect and social effect.

With the development of sound technology and the change of communications media，there emerged a turn to“sound”in modern China. It carried on the ideal of enlightenment and national salvation that had been passed down from the Opium Wars，and focused on“sound”as a communication tool. Both the vernacular writing movement and the sound film are participants of this turn to sound. They upheld the scientific and democratic New Culture，advocated the values of freedom and progress，promoted the new scientific，democratic，national，and popular aesthetic spirit，and prompted the transformation of the traditional Chinese society to a modern one. On the one hand，the vernacular culture cultivated the auditory unconsciousness of the modern public，providing a psychological preparation for the acceptance and propagation of sound film；on the other，sound film established a more inclusive and diversified space for the vernacular culture. In the accepting and popularizing course of sound film，the vernacular in the films was attached with various kinds of imagination，embodied the political appeals and family-country ideals of different social groups，and produced different voices as the times changed.
