From the classical statements of the Western legal theories about the differentiation between the public and private laws,it can be roughly deduced that the basic rights are designed to effectively combat the illegal infringement of the state power;completely denying the value of the basic rights in the process of dealing with private relations constitutes the core of the traditional German constitutional doctrine of“invalidity”。 However,with the deepening development of academic research and judicial practice,more attention is paid to the application of the basic rights in private law relations,which has triggered public law scholars’systematic review of the normative implications of the basic rights. Therefore,it is necessary,at the theoretical foundational level,to do away with the traditional prejudice of“invalidity”which only emphasizes the subjective orientation of the basic rights,and to reconsider the cognitive argument that the theory of the validity of the basic rights to the third party is objectively oriented.Examining the logical relationship between the normative implications and functions of the basic rights may deduce the dual nature of the basic rights’normative validity. This is the proposition of the times that modern Chinese on stitutional studies can hardly avoid.

The MFN clause has become one of the core provisions of an international investment treaty and plays a very important role in the liberalization of international investment. The“host country - investor”dispute settlement procedure is laid down in a large number of modern international investment treaties.This procedure,however,has different contents in different investment treaties,of which the host country and the investors are wild apart in their understanding,causing a controversy over whether the MFN clause can be applied to international investment dispute settlement. According to the theory of the international treaty law,the purpose of the MFN clause in international investment treaties is to promote,rather than deplete,the contracting parties’interests. From the perspective of the investors’home country,the expanded application of the MFN clause in international arbitration practice to the international investment dispute settlement procedure is more disadvantageous. This will seriously affect the investor’s home country’s understanding and reasonable judgment of the legal obligations in the treaties,which may even be contrary to the treaties’original intensions. Thus,the application of the MFN clause should not be included in the investment dispute settlement procedure unless the contracting parties specify such an application in the treaties.

Blind date is an act of mutual interest choice of both parties and most people tend to adopt a“looking upward”strategy. Blind dating,similar to buying a call option,presents five different situations:1.“follow the man you marry,be he fowl or cur”;2. be a live-in son-in-law;3. merge materials and properties of the two sides;4. seek spiritual blending;5. expect a marriage to alleviate poverty. The changes of family and social structures can be clearly seen from the blind-date perspective. Blind date,urban spatial agglomeration,and urban development are closely related to one another. The urban space and population aggregation propels the continuous increase of families ‘ living cost,and blind date further expands the cost and will reduce families’index of happiness. Blind-date economy is totally different from the market economy;the market economy can be optimized through resource adjustment by an“invisible hand”while the blind-date economy does not have such a hand to do so. Freedom to choose one‘s spouse,involvement of relatives or friends,and blind date are three different forces that can manipulate marriage and matchmaking behaviors during China’s urban and rural economic development process and the blind-date economy is more an endogenous variable.

Considering the fact that Li Jinfa’s three major poetry works were written during the years of 1920 and 1924 in Paris and Berlin respectively,instead of studying Li Jinfa’s interactions with his Chinese contemporary poets,it would be more fruitful to examine his poetry in the context of European modernism and discursive streams of modernity. Under the influence of Baudelairean poetics of counterenlightenment and anti-pastoral modernism,there emerged a terrible crisis of économie libidinale born out of the physical exhaustion paralleled with the spiritual lassitude rampant in Li Jinfa’s poetry. The satanic passions against illumination constitute a return to the cave of darkness,sleep,coldness,humidity,and muddiness. This negative aesthetical poetics of modernity means to question and challenge the grand narrative of modernity and the myth of progress.
