Abstract: The amended Legislation Law gives the People’s Congresses and their standing committees of municipalities with district divisions (MDD) the power to enact local rules and regulations and has established a series of systems to prevent the abuse of this power；the system of provincial People’s Congress standing committee to approve MDD’s rules and regulations is crucial. However，the Legislation Law does not specify，in the approval system，the reviewing and approving procedures，the content to be reviewed，and actions to take after reviewing. The approval system need to be improved through legislation by provincial People’s Congresses on the principles of“non-contravention”and respecting local initiatives. The improvement must emphasize the quality of legislation and focus on application procedure，content，reviewing methods，and actions to take after reviewing.
