Abstract: Some problems exposed in carrying out civil mediation system of our country prove the importance of inspecting the mediation. But in legislation, the regulation for the procuratorate to monitor the civil lawsuit mediation activity is imperfect with the unclearness of consciousness in the legislation theory. To include the civil mediation into the scope of inspecting and monitoring is in accordance with basic spirit of Constitution and Law of Civil Lawsuit and also inevitable demands for the dual judicial structure.
