Abstract: As the ageing degree increases in China，its old population is on the rise. The traditionalways of elderly care by the family，residential community，and society can hardly cover the ever developing elderly service needs. The China National Committee on Ageing then proposed theconcept of intelligent elderly care， which initiated the exploration of smart elderly care. The achievements of AI and Internet technology are also being embedded in the elderly care industry and fields，providing great convenience and benefits for the senior’slife，health，medical treatment，emotional support，social participation，and other rights and interests. But meanwhile，intelligent technology may also make the elderly risk the infringement of personal information protection，privacy，property rights and other aspects. When AI technologies are applied to protect the rights and interests of the elderly in China，we should fully consider the ageing suitability of their projects or products，improve relevant regulatory laws，strengthen the supervision of national public power，and follow the path of multi-subject co-governance.
