摘要/Abstract

摘要： 人工影响天气致损的法律救济有多种途径，法院的司法救济是一种重要的方式。法院应以促进法治为立足点，通过精准的适用法律、合理的选择法律，并巧妙运用法律原则保护公民权益。在此定位基础上法院可通过自身管理创新充分发挥司法职能，通过调查研究提供完善立法建议，通过司法建议及定期指导，向政府提供管理意见，通过沟通交流培育社会管理创新的良好氛围。

Abstract: Ways in applying for legal remedies for damages caused by weather modification are many, one of which is judicial remedy of the law court, an important one. The court should promote the idea of taking legal management as a stand, and protect civil rights by the principles of carefully, properly and tactically selecting laws. On the basis of this, courts can make full use of judicial function by their own management innovation, offer suggestions of improving legislation by investigation, provide government with management advice by judicial suggestion and regular guidance and cultivate fine atmosphere of social management innovation by communication.
