流动劳工工会身份合法性的实践类型

Practical Types of Migrant Labor Unions’Identity Legality

摘要: 工会的身份合法性在实践中存在争议。在田野调查基础上对三类面向流动劳工服务的工会组织架构及工作机制进行分析发现:三个工会身份在形式上都表现出法理型合法性特征,但是实践中又分别表现出传统型或魅力型或二者兼具的合法性特征,三个工会因为身份合法性带来的实践困境主要体现为工会工作功能悬浮、功能依附及功能滞后。依据哈贝马斯的合法性视角,三个工会的身份合法性仍然面临危机,即它们虽然满足了经验向度的社会有效性,但是在规范向度的有效性方面仍面临合法性危机。

Abstract: The identity legality of labor unions has been disputed in practice. The organizational structure and the working mechanism of three types of labor union that serve migrant workers are analyzed based on field investigation. In form,all the three types of labor union are legal-rationally legitimate in terms of identity,yet in practice,their legitimacy features can also be traditional,charismatic,or a combination of both. The practical dilemma of the three types of labor union due to their identity legality includes the insubstantiality,dependence,and lagging behind of labor union’swork and function. From Habermas’s perspective of legal legitimacy,the identity legitimacy of the three types of labor union is still in jeopardy:although empirically they are socially effective, they are faced with a legitimacy crisis in terms of specification effectiveness.
